Miami Beach, Florida — A Miami Beach hotel is facing a multimillion-dollar lawsuit after a family alleged that inadequate security measures contributed to a disturbing incident involving their 11-year-old daughter at the property’s swimming pool.
The lawsuit was filed against a Radisson Hotel located on Collins Avenue and 43rd Street, with the family seeking more than $15 million in damages.
Family Alleges Hotel Failed to Provide Proper Security
According to reports, the incident took place while the family was visiting Miami Beach from Sweden and staying at the hotel.
The family claims the accused individual, identified as 69-year-old Osvaldo Diaz, was not registered as a hotel guest but was still able to enter the private pool area.
Following the incident, the child’s mother criticized the property’s security presence.
“No, we did never see any security at that time, at any given time, actually,” the mother said.
The family’s attorney, Justin Shapiro, also questioned the hotel’s handling of safety measures.
“We believe this hotel had no security at that point and that is what invites crime like this,” Shapiro said.
Authorities Investigated Incident at Hotel Pool
According to court and arrest records, authorities responded after the child informed her family about an alleged inappropriate interaction that occurred while she was swimming in the hotel pool area.
Investigators said the child and the accused man did not know each other prior to the incident.
The family reported the matter to hotel staff and law enforcement shortly afterward.
According to authorities, the child’s father confronted Diaz after learning what allegedly happened before hotel security became involved.
Suspect Arrested and Charged
Police later detained Diaz after he allegedly attempted to leave the area when officers arrived.
Authorities stated that hotel security helped maintain visual contact with him until officers took him into custody.
Court records show Diaz was charged with:
- Lewd and lascivious battery on a child
- Burglary with assault or battery
Investigators also confirmed that Diaz was allegedly not authorized to be inside the private hotel pool area.
His bail was reportedly set at $15,000, and he remains in custody as legal proceedings continue.
