Family Sues Tesla After Fatal Katy House Crash

KATY, TX – The family of a 76-year-old woman killed when a Tesla crashed into her Houston-area home has filed a lawsuit against Tesla and the driver, seeking over $1 million in damages.

The Fatal Crash

The incident occurred around 8:00 p.m. on Friday in the Houston suburb of Katy. Martha Avila was standing in the front room of her brick residence when a Tesla Model 3 crashed through the wall at a high rate of speed, pinning her in the wreckage.

Avila was airlifted to a nearby hospital, where she was later pronounced dead. A local doorbell camera captured the moments leading up to the high-speed collision.

Lawsuit Alleges Design Defect

The lawsuit, filed in Harris County District Court by Avila’s daughter and son-in-law, alleges negligence and a “design defect” involving Tesla’s automated assist mode.

The driver, Michael Butler, reportedly told the Harris County Sheriff’s Office that he was operating the vehicle with an automated driving assistance system engaged. Authorities confirmed Butler showed no signs of intoxication and has been cooperative. No criminal charges have been filed, but the crash remains under investigation.

Tesla Executives Respond

Tesla CEO Elon Musk and Vice President of AI Software Ashok Elluswamy defended the vehicle’s technology on social media.

  • Elon Musk stated that the system drives slowly through neighborhoods and noted this was a high-speed crash.
  • Ashok Elluswamy claimed that data shows the driver manually overrode the self-driving system by pressing the accelerator pedal to 100% in the residential area.

Tesla’s website maintains that its Autopilot and Full Self-Driving features require a fully attentive driver who is prepared to take over at any moment.

Federal Investigation Launched

The National Highway Traffic Safety Administration (NHTSA) has announced that it is launching a special investigation into the fatal Katy crash.
