Phoenix, Arizona — A deadly confrontation inside a Phoenix apartment has left a father dead and his son behind bars after an argument over an eviction allegedly escalated into a fatal shooting.

Police say the shocking incident unfolded inside the Acero North Valley apartments, where a dispute between a father and son turned violent within seconds.

Argument Over Apartment Ends in Gunfire

According to investigators, 28-year-old Joseph Gabriel Peixotto had returned to the apartment to collect personal belongings that were being stored there.

A roommate later told police that the suspect mentioned his father was “kicking him out” of the apartment before tensions escalated.

The witness reportedly heard arguing coming from another room before hearing the victim, 50-year-old Joseph Elmer Peixotto, confront his son after noticing he had a firearm.

“What, you gonna shoot me?” the father allegedly said moments before gunfire erupted, according to an arrest affidavit.

Seconds later, the roommate heard two gunshots.

Roommate Discovers Victim After Shooting

After the blasts, the roommate reportedly found Joseph Elmer Peixotto lying on the floor suffering from gunshot wounds to the chest.

Emergency services were immediately contacted, and the horrifying aftermath was partially captured during the 911 call.

“The witness asked the defendant why he shot his father,” the affidavit says. “The defendant made a statement, which was captured in the background of the 911 call, that the victim was going to ‘beat my a—.'”

Authorities say the roommate did not hear any physical fight before the shooting and also did not hear either man make direct threats beforehand.

Police Take Suspect Into Custody

Phoenix police officers arrived at the apartment shortly after the shooting and took Joseph Gabriel Peixotto into custody without further incident.

Investigators attempted to question him about the deadly confrontation, but according to police documents, he requested an attorney and no additional statements were taken.

The suspect was later booked on a charge of second-degree murder.

Court records show he is currently being held on a $1 million bond as the investigation continues.

The roommate provided investigators with additional details about what happened in the apartment leading up to the fatal encounter.

“The defendant came in … sometime before the shooting, to get his personal belongings that he had stored in the witness’s bedroom and said his father was kicking him out of the apartment,” the affidavit recounts.
