BATAVIA, OH — A 30-year-old Clermont County man is facing life in prison after being indicted on a slew of charges, including murder, in connection with the horrific death of his 4-month-old daughter.
Marcellaus Malone appeared in court on Wednesday, April 22, where he pleaded not guilty to charges of murder, involuntary manslaughter, domestic violence, and seven counts of endangering children. Following the hearing, a judge set his bond at a staggering $3 million.
A Night of Tragedy
The investigation began on the night of December 11, 2025, when authorities responded to a home in Clermont County. Prosecutors say the infant’s mother had swaddled the baby before Malone placed her in a bassinet. He was allegedly the last person to see the child alive.
At 12:30 a.m., the mother called 911 to report that the infant was not breathing. Despite both parents purportedly performing CPR, the baby was pronounced dead shortly after arriving at the hospital.
Disturbing Evidence of Long-Term Abuse
While the initial call appeared to be an accidental tragedy, Clermont County Prosecutor Mark Tekulve says a deeper investigation revealed a “callous and evil” pattern of abuse dating back at least two months.
Assistant Prosecutor Nick Horton presented chilling evidence during the court hearing:
- Death Threats on Video: Investigators discovered footage of Malone allegedly threatening the infant, telling her she was going to be a “dead baby” and that he would “toss her on the bed” if she angered him.
- Physical Violence: Prosecutors allege that on at least one occasion, Malone punched the 4-month-old in the face because she was crying, causing significant bruising.
- Manner of Death: The autopsy revealed that the infant died from occlusion of the nose and mouth. Prosecutors allege Malone swaddled the baby so tightly that she could not breathe and passed out.
“Unspeakable Violence”
Prosecutor Mark Tekulve expressed his office’s commitment to seeking justice for the infant, stating, “Children are our most precious gifts. It is unthinkable that this innocent child could have been treated in such a callous and evil manner.”
If convicted on all counts, Malone faces the possibility of life behind bars. He currently remains in custody at the Clermont County Jail.
