Lexington, Minnesota — A tragic case of alleged domestic violence has shaken a quiet neighborhood after authorities say a man fatally shot his estranged partner and her young son just hours after a heated dispute about legal action.
Police have arrested 53-year-old Irving Van Marsaw, who is now facing two counts of second-degree murder in connection with the deaths of 44-year-old Jennifer Sue Marsaw and 5-year-old Marzai Andrew Dawson.
History of threats and restraining orders
According to court documents, the relationship between the accused and the victim had been marked by ongoing threats and alleged abuse.
Jennifer Marsaw had previously sought protection through restraining orders, telling the court:
“He threatens to hurt me if I don’t tell him where I live.”
In a later filing, she also alleged:
“He has threatened to kill my children and myself.”
Although restraining orders were granted, records show they were later withdrawn, adding complexity to the case and raising concerns about ongoing safety.
Final argument before deadly incident
Authorities say the violence may have been triggered after a confrontation on March 17, when Jennifer reportedly asked the defendant to leave the home following an argument involving a knife.
Later that evening, during a phone conversation, she reportedly told him she intended to move forward with legal action.
“You better believe I’m going to trial,” she said, according to a witness.
The suspect allegedly responded briefly before ending the call, and within hours, the situation escalated into violence.
Children witness aftermath of shooting
Shortly after midnight, Jennifer’s daughter and younger siblings briefly stepped outside the home. When they returned minutes later, they heard multiple gunshots.
According to investigators, one of the children saw the suspect leaving the home with a firearm.
“He was holding a handgun as he exited,” the complaint states.
Moments later, the children discovered their mother and younger brother had been shot inside the house. They quickly ran to a neighbor’s home to call 911.
Victims found with critical injuries
Responding officers arrived to find Jennifer Marsaw with fatal gunshot wounds to the chest. Her 5-year-old son was still alive but critically injured.
He was transported to a hospital, where he was later pronounced dead.
“Both victims sustained severe gunshot wounds at close range,” authorities confirmed.
The devastating loss has left the family and community in shock.
Suspect apprehended after search
Police quickly identified Irving Marsaw as the suspect based on prior interactions and witness descriptions. A search operation was launched, and officers used a K-9 unit to locate him hiding in a wooded area nearby.
He was taken into custody shortly after.
Authorities later recovered a firearm believed to be connected to the incident.
